Worker's Compensation: Notice to Injured Workers and Employers

DWD has developed a poster that informs both employees and employers of their rights and responsibilities under Wisconsin Worker's Compensation law. This free publication also provides a space for employers to include information about their insurance carrier or claim administrator in the event of a claim.

Insurance carriers and self-insured employers have the primary responsibility for processing workers compensation claims for injured workers. This responsibility includes making payments that are due to injured workers in a timely manner. Furthermore, this expectation includes communicating to the Workers Compensation Division by sending required reports and replying to all correspondence.

Worker's Compensation actively participates in the EDI Project, via FTP, sponsored by the International Association of Industrial Accident Boards & Commissions (IAIABC). Insurance Letters #453 and #455 provide instructions on information and forms that are now required to be electronically transmitted via EDI or the Insurer Pending Reports via the Insurer Portal.

There has been an amendment to Wis. Stats. 102.13 (2) (c). A filing of a final medical report in cases with eye injuries where the employee received treatment on three or more occasions off the employer's premises, even if there is no lost time from work, is now required. As part of its claims monitoring process the Worker's Compensation Division will follow-up with all reported eye injuries as necessary. In cases where there is no lost time it is not necessary for insurance carriers or self-insured employers to report the claim to the Worker's Compensation Division unless the three or more offsite visits threshold is met.

Requests for reimbursement of supplemental benefits should be uploaded using the Insurer Portal. If you must fax non-litigated, claim-related documents, please use our fax cover sheet and send to (608) 260-2503. Use of this cover sheet will help reduce processing time of such documents.

Note: All documents related to litigated claims should be faxed to (608) 260-3053. The Division continues to require that documents related to perm total claims and fatalities be mailed to P.O. Box 7901, Madison, WI 53707.
